SANTA FE, N.M. — Redwolf Pope, 43, who is charged with rape and voyeurism,  has been ordered released from jail by a Santa Fe District Court judge because the local prosecutor failed to provide a written copy of a search warrant affidavit to defense attorneys.

He was charged with kidnapping with intent to commit a sexual offense, criminal sexual penetration and voyeurism for allegedly drugging a woman and having sex with her in a Santa Fe hotel room. Additionally, Pope is accused of video recording his sexual escapades with women in apartments he had in Santa Fe and Seattle.

In the courtroom this week, prosecutors say they provided defense attorneys with digital photos of the search warrant affidavit, instead of paper copies. While the defense argued the case should be thrown out due to this technacality, the judge said that would be too strong, but instead ordered Redwolf to be released as a sanction against prosecutors.

Pope, who claims to be an American Indian activist, demonstrated against the Dakota Access pipeline at Standing Rock. and even was featured on a TEDxSeattle talk about his activism called “Lessons of Courage from Standing Rock. While Pope has claimed to be a tribal citizen, several tribal officials distanced themselves from Pope after his arrest in July 2018.
